The PixOne AI Studio platform (hereinafter "the Service", "PixOne", or "the Platform") is published and operated by:

In accordance with French Law No. 2004-575 of June 21, 2004 (LCEN — Loi pour la Confiance dans l'Économie Numérique), the above information is provided as a legal notice (mentions légales).

By accessing, browsing, or using the Service — whether as a registered user or an anonymous visitor — you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which together form a legally binding agreement between you and GFT.

If you create an account, you expressly confirm your acceptance of these Terms by checking the mandatory acceptance checkbox during registration.

If you do not agree with any part of these Terms, you must immediately stop using the Service.

GFT reserves the right to modify these Terms at any time. Material changes will be notified by email or via the Platform at least thirty (30) days in advance. Continued use of the Service after the effective date of such changes constitutes acceptance of the updated Terms.

PixOne is an AI-powered image editing and video generation platform that allows users to:

• Upload images and modify them using AI models via text prompts (image-to-image editing);
• Generate new images from text descriptions (text-to-image generation);
• Animate images into videos using AI models (image-to-video generation);
• Modify existing videos using AI models (video-to-video editing).

The Service utilizes third-party AI model providers to process user requests. The output is generated by artificial intelligence and is not manually reviewed or curated by GFT prior to delivery, except through automated content moderation systems integrated at the provider level.

The Service is provided on an "as is" and "as available" basis. GFT does not guarantee that AI-generated content will meet your expectations, be accurate, complete, or free from errors or artifacts.

Age requirement: You must be at least eighteen (18) years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you are strictly prohibited from accessing or using the Platform.

Account creation: Some features require registration. When creating an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Anonymous access: The Service provides limited free access to non-registered users, subject to usage limits. GFT employs technical measures to enforce these limits and prevent abuse.

One account per person: Each individual is permitted to maintain only one account. Creating multiple accounts to circumvent usage limits, credit restrictions, or bans is strictly prohibited.

You are solely and fully responsible for all content you upload, all prompts you submit, and all content generated through your use of the Service.

You agree NOT to use the Service to create, attempt to create, upload, distribute, or store any content that:

• Terrorism and violent extremism: Content that promotes, glorifies, incites, or provides instructions for terrorist acts, violent extremism, or mass violence.
• Hate speech: Content that promotes hatred, violence, or discrimination against individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic under French and EU law.
• Illegal activities: Content that facilitates, promotes, or depicts illegal activities including but not limited to drug trafficking, weapons manufacturing, fraud, or human trafficking.
• Intellectual property infringement: Content that infringes upon third-party copyrights, trademarks, trade secrets, or other proprietary rights.
• Misinformation and disinformation: Deliberately false or misleading content presented as fact, particularly content designed to interfere with elections, public health, or democratic processes.
• Spam and abuse: Using automated systems (bots, scripts) to access the Service in a manner that exceeds normal human usage, or to circumvent rate limits, security measures, or content moderation systems.

Content moderation: The AI models used by the Service incorporate automated content moderation systems at the provider level. However, no automated system is infallible. GFT reserves the right — but has no obligation — to review, flag, reject, or remove any content at its sole discretion. The presence of content moderation does not relieve you of your responsibility to comply with these Terms and applicable law.

Reporting: If you encounter content that violates these Terms or applicable law, you may report it to support@pixone.ai. GFT will investigate reports and take appropriate action, which may include content removal, account suspension, and law enforcement referral.

Certain AI models available on the Platform may produce content of an adult or sexually explicit nature ("NSFW Content"). Access to such models is restricted to registered users who are at least eighteen (18) years old.

Even where NSFW content is permitted, the prohibitions in Section 5 apply without exception. In particular:

• NSFW content must not depict minors under any circumstances;
• NSFW content must not depict real, identifiable persons without their explicit documented consent;
• NSFW content must not be used for harassment, blackmail, defamation, or any illegal purpose.

By using NSFW-capable models, you confirm that you are at least 18 years old and accept full legal responsibility for all content generated.

7.1 Credit System

The Service operates on a credit-based system. Credits are consumed each time you generate content. The credit cost varies by AI model, output type (image or video), duration (for videos), and resolution. Current credit costs are displayed in the application interface prior to generation.

7.2 Subscription Plans

GFT offers monthly subscription plans that provide a recurring credit allowance. Current plans and pricing are displayed on the Pricing page. Subscriptions are billed monthly in advance via Stripe. Credits granted by subscription are non-transferable and non-refundable.

7.3 Credit Packs

Users may purchase additional credit packs as one-time purchases. Credit packs are non-transferable and non-refundable once purchased.

7.4 Welcome Bonus

New registered users may receive a one-time welcome bonus of credits upon account creation. This bonus is subject to change and may be discontinued at any time without notice.

7.5 Failed Generations

If a generation fails due to a technical error (server failure, model timeout, or internal error), the credits consumed will be automatically refunded to your account. Credits consumed for generations that are rejected by content moderation systems are not refundable, as the AI processing was performed and the provider charges apply regardless of the moderation outcome.

7.6 Payment Processing

All payments are processed by Stripe, Inc. GFT does not store your credit card number or banking details. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. All prices are displayed in US Dollars (USD) and include applicable taxes where required by law.

7.7 Subscription Cancellation and Renewal

Subscriptions renew automatically each month until cancelled. You may cancel at any time through the subscription management portal. Upon cancellation, your subscription remains active until the end of the current billing period. No prorated refunds are issued for partial months.

7.8 Right of Withdrawal (EU Consumers)

In accordance with Article L221-28 of the French Consumer Code (Code de la consommation) and the EU Consumer Rights Directive 2011/83/EU, you acknowledge and agree that:

• Digital content (credits) is delivered immediately upon purchase;
• By proceeding with a purchase and checking the acceptance box, you expressly request immediate performance and acknowledge that you waive your 14-day right of withdrawal;
• This waiver applies to both subscription plans and credit pack purchases.

8.1 Platform IP

The Service, including its design, code, user interface, logos, trademarks, and documentation, is the exclusive property of GFT and is protected by French and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes.

8.2 Your Content

You retain all rights to the images you upload to the Service. By uploading content, you grant GFT a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service (including sending your images to AI model providers for processing).

8.3 AI-Generated Content

Ownership of AI-generated content is a rapidly evolving legal area. GFT does not claim ownership of AI-generated outputs created through your use of the Service. However, GFT makes no representation or warranty regarding your ability to claim copyright or other intellectual property rights over AI-generated content, as this depends on applicable law in your jurisdiction and the policies of the underlying AI model providers. You use AI-generated content at your own risk and responsibility.

8.4 Third-Party AI Providers

The AI models used by the Service are provided by various third-party AI providers. Your use of AI-generated outputs may be subject to the terms and conditions of those providers. GFT is not responsible for changes to third-party model availability, capabilities, or terms.

GFT processes personal data in accordance with the EU General Data Protection Regulation (GDPR) 2016/679, the French Data Protection Act (Loi Informatique et Libertés), and our Privacy Policy, which forms an integral part of these Terms.

By using the Service, you acknowledge that your uploaded images and prompts are transmitted to third-party AI model providers for processing. This constitutes an international data transfer, which is addressed in our Privacy Policy.

In compliance with Regulation (EU) 2024/1689 (the EU AI Act):

• Transparency: All content generated through the Service is produced by artificial intelligence systems. You must not present AI-generated content as human-created where disclosure is required by law, particularly in contexts involving public discourse, journalism, or advertising.
• Deepfake disclosure: If you use AI-generated or AI-modified content depicting real persons (where lawfully permitted), you are legally required to disclose that the content has been artificially generated or manipulated, in accordance with Article 50 of the EU AI Act.
• Prohibited AI practices: You must not use the Service for any purpose classified as a prohibited AI practice under the EU AI Act, including subliminal manipulation, exploitation of vulnerabilities, social scoring, or real-time biometric identification.

To the maximum extent permitted by applicable law:

• GFT provides the Service "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• GFT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.
• GFT's total aggregate liability to you for any claims arising from or related to these Terms or the Service shall not exceed the total amount you have paid to GFT in the twelve (12) months preceding the claim.
• GFT is not responsible for the output, quality, accuracy, legality, or appropriateness of AI-generated content. AI models may produce unexpected, inaccurate, offensive, or inappropriate results. You assume all risk associated with AI-generated content.
• GFT is not responsible for the actions, omissions, or content of third-party AI model providers, payment processors, or hosting services.
• GFT is not liable for any damage or legal consequences arising from your violation of these Terms, applicable law, or the rights of third parties through your use of the Service.

Nothing in these Terms excludes or limits GFT's liability where it cannot be excluded or limited under applicable law, including liability for fraud, intentional misconduct (dol), or gross negligence (faute lourde) under French law.

You agree to defend, indemnify, and hold harmless GFT, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Service;
• Content you upload, prompts you submit, or AI-generated content you create, distribute, or publish;
• Your violation of these Terms or applicable law;
• Your infringement of any third-party rights, including intellectual property, privacy, or publicity rights;
• Any claim by a third party that content generated through your use of the Service caused them harm.

GFT reserves the right to suspend or permanently terminate your account, without prior notice or refund, if:

• You violate these Terms, particularly the Prohibited Content provisions (Section 5);
• You use the Service for illegal purposes;
• You create multiple accounts or circumvent security measures;
• GFT is required to do so by law, regulation, or court order;
• Your use poses a risk to other users, GFT, or third parties.

Upon termination: (a) your access to the Service will be immediately revoked; (b) any remaining credits are forfeited and non-refundable; (c) GFT may retain data as required by law or for legitimate legal purposes; (d) provisions that by their nature should survive termination (including Sections 5, 8, 11, 12, 14, and 15) shall survive.

You may delete your account at any time by contacting support@pixone.ai. Account deletion does not entitle you to a refund of unused credits.

Governing law: These Terms are governed by and construed in accordance with the laws of the French Republic, without regard to conflict of law principles.

Jurisdiction: Any dispute arising from or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Paris, France, subject to the mandatory consumer protection provisions of your country of residence where applicable under EU law (Regulation (EU) 1215/2012).

EU Consumer Dispute Resolution: In accordance with Regulation (EU) No 524/2013, EU consumers may submit complaints to the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. GFT's email for ODR purposes is support@pixone.ai.

Mediation (French consumers): In accordance with Articles L611-1 to L616-3 of the French Consumer Code, you may resort to a consumer mediator before bringing court proceedings. Details of the appointed mediator are available upon request at support@pixone.ai.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and GFT regarding the Service and supersede all prior agreements.

Waiver: GFT's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Assignment: GFT may assign its rights and obligations under these Terms without your consent. You may not assign your rights or obligations without GFT's prior written consent.

Force majeure: GFT shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to natural disasters, war, strikes, government actions, internet disruptions, or third-party service provider failures.

Language: These Terms are drafted in English. In the event of a conflict between the English version and any translation, the English version shall prevail, except where prohibited by applicable law.
